Welcome, and thank you for your interest in Simple But Needed, Inc. (“SBN,” “we,” or “us”). This Privacy Policy (“Policy”) covers our website at https://sbnsoftware.com (the “Site”), as well as all related web sites, networks, embeddable widgets, downloadable software (including any development kits and any associated tools also known as SDKs), mobile applications, and any services provided by us for which a link to this Policy is displayed (collectively, together with the Site, our “Service”).

Personal Data We Collect

Personal data, or personal information, means any information about an individual from which that person may be identified. For example, it may include an individual’s name, address and gender. It does not include data from which the identity of an individual has been definitively removed (also known as anonymous or anonymized data).

We may collect personal data either directly from you, such as when you register to use the Site, or indirectly, such as from your electronic devices that interact with our Site.

Where applicable, we indicate whether and why you must provide us with your personal data, as well as the consequences of failing to do so. If you do not provide personal data when requested, you may not be able to benefit from our Service if that information is necessary to provide you with the Service.

  • a password in order to create an account and user profile.

User Content. We will collect information that you upload, post, or stream when you use the Service. For example, when you interact with other users by sending them messages or video chats, the Service will process the information you provide in such submissions, to the extent permitted under applicable law. This may also include the information regarding your contacts that you choose to import into the Service. We may also keep records related to the use of the Service for the account owner to verify, track assets managed using the Service, or what training materials have been viewed by users registered under an Enterprise Customer Account. This information may be provided to the account owner.

Communications with SBN. We will collect any information that you provide to us through your communications to us, such as your name, email, phone number, address, time zone and/or product interests, as well as any other specific product or support questions  when you communicate with our customer support team, when you choose to register for a demonstration of the Service, or when you choose to submit any other general inquiries through the Site. This information is collected to provide a better user experience and enable us to address any of your concerns.

Testimonials. When you authorize us to post testimonials about our products and services on our website, we may include your name and other personal information in the testimonial. You will be given an opportunity to review and approve the testimonial before we post it. If you wish to update or delete your testimonial, you can contact us at support@simplebutneeded.com

Sensitive Data.  We do not (and do not want to) collect any sensitive data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.

B. Personal Data Collected via Automated Means

In addition to information that you provide to us, we may collect information about you and your use of the Service via automated means, such as cookies.

Cookies and Similar Technologies. When you visit the Site, we may collect technical data about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we may collect information about the individual web pages or Services that you view, what websites or search terms referred you to the Platform, and information about how you interact with the Platform. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. This information is gathered from all users. We refer to this information as “Device Information.” We collect Device Information using the cookies, log files and other technologies as described below in Cookies and Tracking Technology.

Some cookies are required for the proper functioning of our Site and other are used for analytics purposes which help us to provide you with more personalized and customized services and a better digital experience.

Log Data. Our web servers keep log files that record data each time a device accesses those servers and those log files contain data about the nature of each access, including originating IP addresses.

C. Personal Data Obtained from Third Parties

Our Enterprise Customers. If you are using the Service as an end user of an Enterprise Customer, we may collect personal data about you from our Enterprise Customers who use the Services with their own end users – most often their employees. This information may include your name, title, location, email address and phone number.

Information from Posted Reviews and Conferences.. If you register for or attend an event that is sponsored by Simple But Needed, the event organizer may share your information with us. Simple But Needed may also receive information about you from review sites if you comment on any review of our products and services, and from other third-party service providers that we engage for marketing our products and services.

Cookies and Tracking Technology
Cookies, Log Files and Pixel Tags

As you interact with us via the Site, we (or authorized third party partners) may collect Device Information in order to enable us to provide the best customer experience. We may collect Device Information using the following technology:

  • Cookies are data files that are stored on a user’s hard drive containing information about the user.
  • Log files track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • Web beacons, tags and pixels are small strings of code that represent a clear graphic image and allows us to capture certain additional types of information about a visitor’s actions on a website, such as a visitor’s cookie number, the time, date, duration and number of page views, a description of the page where the tag is placed and details about any items that were purchased. Pixel tags help us analyze our users’ online behavior and measure the effectiveness of our Site.

We generally use session cookies to save your preferences, and such cookies expire when you close your browser. We also use persistent cookies to authenticate users and for support for the internal operations of the Site.

Purpose of Cookies and Tracking Technology

As explained above, you can see that cookies (including the above tracking technologies) are tools that we – and everyone one else who operates online – use in order to provide a functional and high-quality user experience. Cookies or tracking technologies on our Site serve different purposes:

  • Strictly Functional Cookie.  First and foremost, cookies help our Site work best. They help us work behind the scenes to make your user experience a lot easier. You would miss a lot of these things if they were gone – such as easily logging in and moving from page to page.
  • Performance Cookies.  Other cookies collect information about how visitors use our Site, and measure how well the Site works – such as whether a visitor gets an error message from our web pages. These cookies don’t collect information that identifies a visitor. All of the information that these types of cookies collect is aggregated and used to improve how our Site works.

How We Use Personal Data We Collect

We process your personal data for different purposes. Generally, we use personal information to provide our Services, communicate with our users, maintain a safe and secure platform, and better understand the needs of our users,

More specifically, we use Personal data that we collect for the following purposes:

Internal and Service-Related Usage. We use your personal data to operate, maintain, enhance and provide all features of the Service and our Site, to provide other services and information that you request, to respond to comments and questions and to otherwise provide support to users.

Analytics and Improving the Service. We use  aggregated and anonymous data to understand and analyze the usage trends and preferences of our users, to improve the Service or our software, and to develop new products, services, feature, and functionality, but such data does not include any information in personally identifiable form.

Communications. We may use your email address or other personal data (i) to contact you for administrative purposes such as customer service or (ii) to send communications, including updates on promotions, relating to products and services offered by us. You always have the ability to opt-out of receiving any promotional communications relating to products and services offered by us as described below under “Your Rights and Choices.”

Tailored Content. We may use your personal data to: (i) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Service; (ii) provide customized content, and information.

Aggregate Data. We may de-identify and aggregate information to monitor and analyze the effectiveness of Service and to monitor aggregate site usage metrics such as total number of visitors and pages viewed.

Partners and Vendors. We use personal data in the form of business contact information provided to us for contacting the personnel of our business partners and vendors to manage those relationships.

Job Applications. If you apply for a job at SBN, we may process your personal data to evaluate your application.

Legal. We may use your personal data to enforce our Terms of Service or other legal agreements, to defend our legal rights, to comply with our legal obligations and internal policies.

Other Purposes. We also may use your personal data as may be described in a notice to you at the time the information is collected, or in any other manner to which you consent.

How We Disclose Your Personal Data

Except as described in this Policy or otherwise disclosed to you at the time of the collection, we will not disclose your personal data to third parties without your consent. We may disclose information to third parties in the following circumstances:

  • SBN affiliates and subsidiaries. We may disclose personal data about you with our affiliates and subsidiaries.
  • Other users. Any personal data that you voluntarily choose to include on or through the Service, including information in a publicly accessible area of the Service (such as a public profile page) or information that you share with or allow to be shared with other users, will be available to anyone who has access to that content, including other users. We are not responsible for privacy practices of the other Users who will view and use the posted information.   
  • Vendors and Service Providers. We work with third party service providers such as Amazon Web Services to provide website or application development, hosting, maintenance, and other services for us. These third parties may have access to or process your personal data as part of providing those services for us. We limit the information provided to these service providers to that which is necessary for them to perform their functions, and we require them to agree to use such information solely to perform the service for us in accordance with the terms of this Policy.
  • Our Enterprise Customers. If you are using the Service as an end user of an Enterprise Customer, we may disclose information about you to the Enterprise Customer, such as asset location or training videos that have been viewed.
  • Other Third Parties. We may also share personal data about you with other third parties in the following circumstances:
    • In Aggregated Form. We may make certain automatically-collected, anonymous, aggregated, or otherwise de-identified information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Service.
    • To Comply with Legal Obligations. We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with the legitimate requests of law enforcement or other governmental agencies.
    • To Protect and Enforce Our Rights. We also reserve the right to disclose your information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Service and any facilities or equipment used to make the Service available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.
    • In case of Merger, Sale, or Other Asset Transfer. Information about our users, including personal data, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
    • With Your Consent. We also may disclose your personal data as may be described in a notice to you at the time the information is collected, or in any other manner to which you consent.
Your Rights and Choices

Account Information. You may, of course, decline to share certain personal data with us, in which case we may not be able to provide to you some of the features and functionality of the Service. You may update, correct, or delete your profile information and preferences at any time by accessing your account settings page on the Service or contacting your administrator. If you wish to access or amend any other personal data we hold about you, or to request that we delete any information about you that we have obtained from an Enterprise Customer, you may contact us at support@simplebutneeded.com. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so, to the extent permitted under applicable law.

Opt-Out. If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt-out from receiving commercial email from us, and any other promotional communications that we may send to you from time to time, by sending your request to us by email at support@simplebutneeded.com or by writing to us at the address given at the end of this policy. We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Service.

Please be aware that if you opt-out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may receive promotional communications from us that you have opted-out from during that period, unless we are required by applicable law to process your request within a shorter period of time. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Service.

Privacy Settings. Although we may allow you to adjust your privacy settings to limit access to certain personal data, please be aware that no security measures are perfect or impenetrable. To the fullest extent permitted under applicable law, we are not responsible for circumvention of any privacy settings or security measures on the Service. Additionally, we cannot control the actions of other users with whom you may choose to share your information. To the fullest extent permitted under applicable law, we cannot and do not guarantee that information you post on or transmit to the Service will not be viewed by unauthorized persons.

Do Not Track. Some web browsers incorporate a “Do Not Track” feature. Because there is not yet an accepted standard for how to respond to Do Not Track signals, our website does not currently respond to such signals.

Third Party Services

This Policy applies only to the processing of your personal data by SBN. The Service may contain features or links to websites and services provided by third parties. For example, the Service may contain links to the website of third parties that license content to us for inclusion in the Service. The policies and procedures described in this Policy do not apply to Third Party Sites. Any information you provide on third-party sites or services is provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the Service. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through the Service. We encourage you to learn about third parties’ privacy and security policies before providing them with information.

Children’s Privacy

Protecting the privacy of young children is especially important. Our Service is not directed to children under the age of 16, and we do not knowingly collect personal data from children under the age of 16 without obtaining parental consent. If you are under 16 years of age, then please do not use or access the Service at any time or in any manner. If we learn that personal data has been collected on the Service from persons under 16 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information.

Data Security

We have put in place appropriate security measures designed to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. For example, we use encryption, secure socket layer, firewalls, and password protection. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need-to-know.

If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice through the Service if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. No method of transmission over the internet, or method of electronic storage, is 100% secure. While we take all reasonable steps necessary to provide the most secure Site and Service, we cannot ensure or warrant the security of any information you transmit to us or store on the Service, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Data Retention

We will only keep your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, as well as applicable legal requirements.

By law, we may be required to keep basic information about our customers, such as payment data, generally for seven years after they stop being customers for tax purposes.

Please note that we may retain information that is otherwise deleted in anonymized and aggregated form, in archived or backup copies as required pursuant to records retention obligations, or otherwise as required by law.

International Transfers

SBN is based in the United States. The personal information that we collect are sent to and stored on secure servers located in the United States. Such storage is necessary in order to process the information. We may transfer the personal data that we collect from you to the third parties mentioned in the circumstances described above, which may be situated outside of your country or regional area, and may be processed by staff operating outside of your country or regional area. In particular, information provided to us or collected by us likely will be processed in the United States by us or our agents and contractors. The data protection laws of the United States or other countries may not be as comprehensive or equivalent to those in your country of residence. For instance, the European Union’s General Data Protection Regulation (“GDPR”) allows for transfer of personal data from the European Union to a third country in certain situations. By your continued use of the Site and Services, and agreeing to the terms of use and this Policy, you agree to the transfer of your information to the United States and to the processing of that information by SBN on servers located in the United States as described in this Policy. Wherever we transfer your personal data, we will take reasonable steps to ensure that your privacy rights continue to be protected. Additional Rights of Users in the European Economic Area

• The right of access – that’s a right to make what’s known as a ‘data subject access request’ for copy of the personal data we hold about you;

• The right to erasure – that’s also known as the ‘right to be forgotten’ where in certain circumstances you can ask us to delete the personal data that we have about you (unless there’s an overriding legal reason we need to keep it);

• The right to restrict processing – that’s a right for you in certain circumstances to ask us to suspend processing personal data;

• The right to data portability – that’s a right for you to ask us for a copy of your personal data in a common format (for example, a .csv file);

• The right to object – that’s a right for you to object to us processing your personal data (for example, if you object to us processing your data for direct marketing); and

• Rights in relation to automated decision making and profiling – that’s a right you have for us to be transparent about any profiling we do, or any automated decision making.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
